The phrase "employment at will" has no place in Indian law. Employers and employees both benefit from knowing where the line sits.
Indian employment law distinguishes between workmen under the Industrial Disputes Act and employees outside that definition. The protections differ sharply.
For workmen
Retrenchment requires notice, compensation and, in establishments above the statutory threshold, prior permission. Non-compliance renders the termination liable to be set aside with back wages.
For others
Termination is governed by the contract and by the applicable Shops and Establishments Act. A contractual notice period must be honoured, and a termination that is punitive in substance while framed as simple discharge remains open to challenge.
Documentation matters
- Performance concerns recorded contemporaneously, not reconstructed later
- A fair opportunity to respond where misconduct is alleged
- Full and final settlement computed correctly, including gratuity where earned
